TERMS & CONDITIONS

The following terms and conditions are applicable to quotes placed through UBench Fitness Company South Africa (Pty) Ltd., hereinafter referred to as UBench.

Whilst every effort has been made to ensure that the information contained on this website and in our brochure is current and accurate, UBench cannot be held liable for any errors, omissions or price changes.  All equipment and accessories are subject to availability.

The use of any equipment purchased from UBench is at the customer’s own risk.  UBench will not entertain any refunds and will not be held responsible for any damages or injury suffered whatsoever as a result of using any equipment purchased.

Please consult your doctor before using any fitness/gym equipment purchased.

PRICING:

Unless otherwise stated, all prices are in South African Rand (ZAR) and include 15% VAT but exclude delivery, assembly/installation and transport costs unless otherwise specified in writing by UBench.

PAYMENT OF PRE-ORDERED STOCK:

Pricing is valid for 7 days from date of quotation and thereafter subject to price variation based on prevailing ZAR/USD exchange rates and confirmation.

50% non-refundable deposit is to be paid immediately to secure your order.  The balance of the quotation amount must be paid and cleared into UBench FNB Business Account before your order leaves our warehouse facility in Durban (South Africa).

Title of goods passes to the customer when the shipment is either delivered by the carrier and accepted and signed for or collected by the customer from our warehouse facility.

Payment can be made via PayGate, Visa, MasterCard or EFT (Electronic Funds Transfer).

INCOMPLETE PAYMENT:

If the customer fails to make final payment within 14 days of UBench notification that the order is ready for delivery/collection then UBench reserves the right to maintain ownership of the equipment and to sell said equipment to defray expenses.  No goods will be given to outside transporters unless UBench has been paid in full.

AVAILABLE STOCK:

If items are not collected within 6 weeks of written notification by UBench to the customer of their arrival, UBench may exercise the option to resell the items to defray expenses.

INSURANCE:

All equipment is insured up to and including delivery to the designated delivery address only (Curbside Freight).  Once delivered, the customer would need to have the necessary insurance in place.

COLLECTIONS:

Orders can be collected from our warehouse facility in Durban (South Africa) by arrangement.  UBench will provide the customer with a designated pick-up time and date.  If collecting, UBench cannot be held responsible for loss or damage once the item leaves the warehouse facility.

DELIVERY:

Delivery is an additional cost.  Please contact UBench for a quotation.

Delivery offered by UBench is Curbside Freight which is the standard delivery service via freight carriers that leaves your product on the first dry landing of your home or business, eg. driveway/front doorstep or commercial storefront.  UBench is not responsible for carrying equipment upstairs/into unusual spaces/any rooms unless prior email communication has been granted on this requirement.

Delivery time periods quoted are estimates only and should not be considered a contractual obligation.  UBench will make every effort to ensure delivery is effected as promptly as possible, however, delays may occur which are beyond our control such as, but not limited to, strikes, floods, fire, mechanical breakdown or any other force majeure condition.

If you have accepted a quotation and have paid the amount due and all products are in stock, then your order should be delivered within 7 to 14 working days.  Outlying areas may take longer for delivery.

Delivery of imported stock is subject to availability from the supplier and will be available between 8 to 14 weeks from date of payment of deposit, however, this time period may vary due to a manufacturing or shipping delay or any other circumstance beyond our control.  UBench will at all times do their utmost to ensure the goods are delivered within the prescribed time frame or as agreed to with the customer but cannot be held liable for any variations in the time period.

If your order is refused or undeliverable for any reason other than damages which can be fixed and resolved upon immediate notification by UBench, the cost of return shipping to the Durban warehouse facility will be for the customer’s account as well as a 10% restocking fee.

When signing for a shipment the customer acknowledges that all cartons shown on the receipt are present and in good condition.  Anything to the contrary must be noted on the delivery document and countersigned by the delivery driver.

For items shipped already assembled, the customer must open all cartons immediately while the delivery driver is present to check contents are in good condition.  Failure to follow this procedure will void the return policy.

INSTALLATION:

Installation and assembly would be an additional cost.  Please contact UBench for a quotation.

If installation is being provided by UBench the customer must remove all breakable items in the path of the equipment that is being delivered.  Due to the excessive weight of our equipment UBench will not be held liable for any damage to property.  Should the delivery address have staircases, wooden or marble flooring that can be damaged, the onus is on the customer to cover and protect the area prior to delivery.

UBench cannot be held liable for any incorrect assembly or installation undertaken by the customer which may result in personal injury or damage to the equipment as a result thereof.

CANCELLATION:

The customer may cancel their order for a full refund prior to the order being shipped.  If the order is cancelled after it has been shipped, but before it has been received, then the customer is responsible for any and all freight charges incurred as a result of the cancellation.  Any unpaid freight charges will be deducted from the customer’s refund.

All custom-made/special orders are non-refundable and may not be cancelled as these products have been specifically manufactured to the customer’s requested guidelines.

EXCHANGE OR RETURNS:

All quotes are irrevocable.  Returns will be rejected if returned without prior written notification via email, including the authorisation by UBench to do so.

Should UBench agree to accept any return of goods, this will need to be in writing and the customer will be liable for a 10% handling charge calculated on the purchase price of the goods.  The onus of proof of return rests with the customer at all times and is to be supported by documentary proof to substantiate any claim for a refund.

Returns must be in the original packaging and be received back at the UBench warehouse facility within 10 days of purchase.  All return transport costs will be for the customer’s account.

UBench reserves the right to inspect all returned products and may reduce the credit if the product is returned with damage other than that which was reported or is incomplete/missing parts.

UBench does not accept returns of the following items unless defective from manufacturer:

  • Gloves, belts, dumbbells and plates
  • Commercial products with obvious signs of use
  • Custom-made or special order items
  • Gift certificates
  • More than 10 days has lapsed since taking delivery of your product

SHORTAGES OR DAMAGES:

In the event that an order is damaged in transit, the customer must include a comment to this effect on the delivery note that the driver has with him.  If the products packaging has been damaged, the customer should contact the UBench Customer Service team with the order number, full name, address and photographs of the damage.  Our Customer Service team will assist with repairs/parts replacement, however, if the damage is not easily fixable, a replacement will be considered.  Extensive damage to packaging must be stated on the delivery note next to the customer’s signature.

Damage to packaging must be reported immediately (within 2 working days) of signing.  Neither UBench nor the courier can be held responsible for short deliveries, damages to packaging and/or items if you do not note them on your delivery note.  This does not affect your statutory rights in the event of the goods being faulty.

Should any damage occur during transit or any defects be noted this must be reported within 7 days of delivery.  Anything thereafter will be moved to after sales service.

AFTER SALES SERVICE:

All after sales service will be provided by UBench as per the below table.

Conditions of UBench After Sales Service:

1. pertains to the customer only and is not transferable.

2. does not cover normal wear and tear as a result of regular use and includes, but is not limited to, gloves, belts, cables, chains, powder coat finishes, upholstery cuts or any other related damage.

3. use of equipment in an uncontrolled setting with high temperatures and excessive moisture (including excessive perspiration on the equipment) may void any after sales service.

4. does not cover damage or failure as a result of unauthorised modifications, use of the equipment other than its intended purpose, discoloration of paint or plastic, neglect, an accident, abuse, corrosion, theft, vandalism, fire, flood, lightning or any other natural disasters.

5. does not cover damage that is not a result of a manufacturer defect, including improper assembly, inadequate maintenance, or installation of other parts or components not manufactured or supplied by UBench.

6. does not cover damage or failure as a result of service by anyone other than an authorised UBench service provider.

Additional Terms & Conditions

 

1. Detailed description of goods and/or service


UBench Fitness Company  is a business in the  online retail  industry that Sells new gym equipment and accessories .

2.  Delivery policy

Subject to availability and receipt of payment, requests will be processed within 7 days and delivery confirmed by way of email with courier details .

3. Export restriction 


The offering on this website is available to South African clients only.

4. Return and Refunds policy

The provision of goods and services by UBench Fitness Company is subject to availability.  In cases of unavailability, UBench Fitness Company) will refund the client 
in full within 30 days.  Cancellation of orders by the client will attract a 10% administration fee. 

5. Customer Privacy policy

UBench Fitness Company shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). The PAIA may be downloaded from: http://www.polity.org.za/attachment.php?aa_id=3569.

6. Payment options accepted

Payment may be made via Visa, MasterCard, Diners or American Express Cards or by bank transfer into the (Your Company) bank account, the details of which will be provided on request.

7. Card acquiring and security

Card transactions will be acquired for UBench Fitness Company  via PayGate (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks.  DPO PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.

8. Customer details separate from card details 

Customer details will be stored by UBench Fitness Company  separately from card details which are entered by the client on DPO PayGate’s secure site. For more detail on DPO PayGate refer to www.paygate.co.za.

9. Merchant Outlet country and transaction currency

The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).

10. Responsibility

UBench Fitness Company  takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.

11. Country of domicile

This website is governed by the laws of South Africa and (Your Company) chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature,  Durban, South Africa.

12. Variation

UBench Fitness Company  may, in its sole discretion, change this agreement or any part thereof at any time without notice.

GENERAL COMPETITION Terms & Conditions

  1. The promoter is UBench Fitness Company.
  2. Our competitions are limited to South African residents residing in KZN, 18 years and older, who are in possession of a valid South African identity document, passport or document of proof of South African residency.
  3. Any director, member, partner, employee, agent or consultant of the Promoter, the marketing service providers or any person who directly or indirectly controls or is controlled by these entities, including their spouses, life partners, business partners or immediate family members may not enter or participate in this promotional competition and will automatically be disqualified upon entry.
  4. Competition entrants must follow the correct mechanics of entry as stipulated on the competition collateral to qualify.
  5. Winners will be selected at random and the promoter’s decision is final.
  6. Prizes are non-transferable and may not be exchanged for cash or credit.
  7. Prize must be claimed within 3 months of winner announcement.
  8. Winners may only redeem their prizes from UBench Fitness Company, and prizes will not be swapped out for cash in the instances where the winner chooses not to or can’t redeem their prize directly from the centre.
  9. Entrant agrees to take part in any marketing activities associated with the promotion including use of names in winner announcements.
  10. All decisions made by UBench Fitness Company, regarding the promotion, the winners or the prizes are final and no correspondence will be entered into.
  11. The winners will be notified via the Facebook page. In the event of the Promoter not being able to contact the winners, the Promoter reserves the right to draw again.
